1. Who We Are

Fushimizu, LLC, a Wyoming limited liability company (“Fushimizu,” “we,” “us,” or “our”), operates the website at fushimizu.com, related client and device portals, and associated online services (together, the “Services”). Fushimizu provides IoT, process control, and automation consulting and product development to companies in the water treatment industry.

This Privacy Policy explains what personal information we collect through the Services, how we use and share it, and the choices and rights available to you. If you have questions, contact us using the details in Section 16.

2. Scope of This Policy

This Policy applies to personal information we collect when you visit our website, submit an inquiry, subscribe to our communications, or use a Fushimizu portal or account. It does not apply to:

  • Information we process on behalf of our business clients (such as equipment manufacturers, OEMs, and dealers) under a written agreement with them. In that role, we act as a service provider or processor, and the client’s own privacy notice governs. See Section 8.

  • Information collected by third-party websites, apps, or services that we link to or that our clients operate, even if they use our technology.

  • Information about our employees and job applicants, which is covered by separate notices.

3. Information We Collect

3.1 Information You Provide to Us

  • Inquiries and contact forms: name, email address, phone number, company name, job title, and the content of your message.

  • Newsletter and email subscriptions: email address, name, and your subscription preferences.

  • Portal accounts: name, business email, phone number, company affiliation, role, login credentials, and multi-factor authentication settings.

  • Business communications: information you share with us in email, meetings, or project correspondence.

3.2 Information Collected Automatically

  • Cookies and similar technologies: see Section 6.

  • Portal security and audit data: login times, authentication events, and actions taken within a portal account, recorded to protect account security and maintain an audit trail.

3.3 Connected Device and Platform Data

When a Fushimizu-enabled water treatment device is installed and connected, the platform may collect device identifiers, operating and performance data (for example, flow, usage, regeneration or service events, alarms, and firmware status), installation location information, and service history. This data is generally collected on behalf of the manufacturer or dealer that sold or services the device. See Section 8.

3.4 Information from Other Sources

We may receive business contact information from our clients, partners, trade shows, and publicly available sources, such as professional networking sites and company websites.

We do not knowingly collect sensitive personal information (such as Social Security numbers, financial account numbers, health information, or precise geolocation of individuals) through the website. Please do not submit sensitive information through our contact forms.

4. How We Use Information

We use personal information to:

  • Respond to inquiries and provide requested information, proposals, and services.

  • Create, operate, secure, and support portal accounts, including authentication and access control.

  • Operate, maintain, monitor, and improve the Services and the Fushimizu platform.

  • Send newsletters, technical updates, and marketing communications that you have requested or that relate to services you use (you may opt out at any time).

  • Send service and security notifications, including alerts relating to connected devices.

  • Analyze website traffic and usage trends to improve content and user experience.

  • Detect, investigate, and prevent fraud, security incidents, and misuse.

  • Comply with legal obligations, enforce our agreements, and protect our rights and the rights of others.

We may create de-identified or aggregated data from personal information. We maintain de-identified data in de-identified form, do not attempt to re-identify it, and may use it for any lawful purpose, including product development and benchmarking.

5. How We Share Information

We do not sell personal information, and we do not share personal information for cross-context behavioral advertising, as those terms are defined under applicable U.S. state privacy laws.

We share personal information only as follows:

  • Service providers: vendors that perform services for us under contractual confidentiality and data-protection obligations, including cloud hosting and infrastructure (Microsoft, Oracle, Amazon Web Services), email delivery, newsletter management, website analytics, and website hosting.

  • Business clients: portal and connected-device data is made available to the manufacturer, OEM, or dealer associated with an account or device, according to role-based access controls and our agreements with those clients.

  • Legal and safety: when we believe disclosure is required by law, subpoena, or court order, or is necessary to protect the rights, property, or safety of Fushimizu, our clients, users, or the public.

  • Affiliates: with companies under common ownership or control with Fushimizu, for purposes consistent with this Policy.

  • Business transfers: in connection with a merger, acquisition, financing, reorganization, or sale of assets, subject to standard confidentiality protections.

  • With your consent: or at your direction.

Global Privacy Control: we treat a Global Privacy Control (GPC) signal from your browser as a valid request to opt out of any sale or sharing of personal information for that browser. Do Not Track: because there is no common industry standard for Do Not Track browser signals, our website does not currently respond to them.

7. Email Communications

You can unsubscribe from newsletters and marketing emails at any time by using the unsubscribe link in any message or by contacting us. We will honor opt-out requests promptly and within the time required by law. Even if you opt out of marketing, we may still send transactional, account, security, and device-alert messages related to services you use.

8. Client Portals and Connected Device Data

The Fushimizu platform is offered to equipment manufacturers, OEMs, and dealers, who in turn provide connected products and services to their own customers, including homeowners and businesses. For data collected through those products:

  • The manufacturer, OEM, or dealer is generally responsible for deciding what data is collected and how it is used, and for providing privacy notices to its customers. Fushimizu processes that data on the client’s behalf and under its instructions, as set out in our written agreements.

  • If you are a homeowner or end user of a connected device and wish to exercise privacy rights, please contact the company that sold or services your equipment. If you contact us directly, we will forward your request to that company where appropriate and assist it as required by our agreement and applicable law.

  • Access to device and account data is limited by role. Users see only the data associated with their organization or their own devices.

  • Portal security records (audit logs) are retained for approximately 13 months and then deleted automatically, unless a longer period is required for an active security investigation or legal obligation.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we become aware of a security incident affecting your personal information, we will notify you as required by applicable law.

11. Your Privacy Choices and Rights

Depending on where you live and on whether a particular law applies to us, you may have some or all of the following rights regarding your personal information:
